Unregistered community design
Unregistered Community Design (UCD) refers to EU design rights for unregistered designs. These are automatic protections that last for 3 years for designs are new and possess individual character upon first public disclosure.
These protections cover designs that are disclosed within the EU but do not extend to the UK, since Brexit a secondary type of UK specific design right referred to as a Supplementary Unregistered Design Right (SUD) was introduced to cover the UK and effectively mirror the EU system. Both systems protect the 2 and 3D visual appearance (shapes, patterns, colours) of a product against copying for three years from the date of first disclosure but only within the respective region. SUDs replaced the previously used UK Unregistered Design Right (UKUDR) which only covered 3D shape and configuration, rather than full visual appearance, including surface decoration and 2D patterns of the SDU.
The right prevents third parties from copying the design, but not independent creation by another party. They are intended for the protection of high turnover design frames such as exhibitions, fashion and so on.
