Trade secrets
Transforming public procurement was published by the Cabinet Office in December 2020. It suggests that ‘trade secrets’ as developed through case law, means: ‘information used in a trade of business, which, if disclosed to a competitor, would be liable to cause real (or significant) harm to the owner of the secret. Typically, this is something unique to the business that gives them a competitive edge and is not already commonly known or easily deducible.’
