Ineffectiveness
STAR Procurement (a shared procurement service for Rochdale, Stockport, Tameside and Trafford Councils), Glossary of Terms, published in May 2019, suggests that: ‘Under the EU Remedies Directive, unsuccessful bidders in a tender can claim ineffectiveness if certain mandatory practices have not been followed by (a public client)… This can result in a contract being deemed ‘ineffective’ by the court, requiring its immediate cancellation and re-procurement.’
