Maintainable highway
According to the New Roads and Street Works Act 1991 (NRSWA), section 86(1), a “maintainable highway” is: '...a highway which for the purposes of that Act is maintainable at the public expense.'
Code of Practice for the Co-ordination of Street Works and Works for Road Purposes and Related Matters HAUC(England) Edition issued by HAUC (England) in September 2020, defines a maintainable highway as: ‘A highway which by virtue of section 36 above or of any other enactment (whether contained in this Act or not) is a highway which for the purposes of this Act is a highway maintainable at the public expense.’
