&lt;div&gt;This section of the Party Wall etc. Act applies where lands of different owners adjoin and:&lt;br /&gt;
&lt;br /&gt;
* are not built on at the line of junction; or&lt;br /&gt;
* are built on at the line of junction only to the extent of a boundary wall (not being a party fence wall or the external wall of a building),&lt;br /&gt;
&lt;br /&gt;
and either owner is about to build on any part of the line of junction.&lt;br /&gt;
&lt;br /&gt;
The notice must be served by the party wishing to build the wall, at least one month before they intend the building work to start, giving a description of the proposed works.&lt;br /&gt;
&lt;br /&gt;
Having been served with the notice, the adjoining owner must serve a notice indicating their consent. This stipulates that the wall should be built on half of the land of each owner or in another position that they may agree on, and that the expense of the wall shall be split between them depending on the use that has been, or is to be, made by them.&lt;br /&gt;
&lt;br /&gt;
If the adjoining owner does not consent, then the building owner is only able to build the wall at their own expense and it must be entirely on their land.&lt;br /&gt;
&lt;br /&gt;

&lt;div&gt;A party structure notice is one of the notices that must be served where the owner of a property (known as 'the building owner') intends to undertake any construction work described in Sections 1, 2 and 6 of the Party Wall etc. Act. 1996.&lt;br /&gt;
&lt;br /&gt;
A party structure notice relates to Section 2 works, which concerns existing party structures, including party walls, floors and partitions (that separate buildings or parts of buildings), party fence walls (essentially a boundary wall between lands in separate ownership which is built astride a boundary), and in some instances, a neighbour's independent property.&lt;br /&gt;
&lt;br /&gt;
These works often include activities such as cutting holes for the insertion of beams and padstones, cutting in flashings, removing chimney breasts, and so on.&lt;br /&gt;
&lt;br /&gt;
A party structure notice must be served at least two months before the date on which it is proposed to start that work. This is different from the other two notices (the Line of Junction notice and the Notice of Adjacent Excavation) which must be served at least one month prior to work commencing.&lt;br /&gt;
&lt;br /&gt;
The information which Notices must contain are:&lt;br /&gt;
&lt;br /&gt;
* The name and address of the building owner.&lt;br /&gt;
* The nature and particulars of the proposed work.&lt;br /&gt;
* The date on which the proposed work will begin.&lt;br /&gt;
&lt;br /&gt;
There are a number of pro-forma notices in use, which generally include the following information as a matter of course regardless of the type of notice:&lt;br /&gt;
&lt;br /&gt;
* The date of the notice.&lt;br /&gt;
* The name and addresses of both the building and adjoining owners (and the addresses of the properties being worked on/affected if different).&lt;br /&gt;
* A statement as to the commencement of works relative to the appropriate notice period.&lt;br /&gt;
* An advisory note explaining what happens if the recipient actively dissents from the works or fails to respond within 14 days.&lt;br /&gt;
&lt;br /&gt;
Below is an example of the wording of a typical party structure notice:&lt;br /&gt;

&lt;br /&gt;

&lt;br /&gt;
The proposed works are: description of the works.&lt;br /&gt;
&lt;br /&gt;
The proposed works do/do not involve special foundations.&lt;br /&gt;
&lt;br /&gt;
I/we attach the relevant plans, sections and details of construction (if applicable).&lt;br /&gt;
&lt;br /&gt;
I/we intend to start works on: date of works.&lt;br /&gt;
&lt;br /&gt;
If you are content for the works to go ahead as proposed please complete, sign and return the attached letter within 14 days of receiving this letter.&lt;br /&gt;
&lt;br /&gt;
If you do not confirm in writing that you are content for the work to go ahead as proposed we will be 'in dispute' under the Act.&lt;br /&gt;
&lt;br /&gt;
In the event of any dispute between us under the Act, would you be willing to agree to the appointment of an 'Agreed Surveyor'? If the answer is ‘yes’ I suggest using (Agreed Surveyor's name) but would be happy to receive your alternative proposal.&amp;lt;br /&amp;gt;&lt;br /&gt;
If the answer is ‘no’, please let me know whom you would appoint as your surveyor.&lt;br /&gt;

&lt;br /&gt;
The aim of most Surveyors and managers is to become a Member of the IPWS. This is a professional grade, and is granted after success at the &amp;amp;quot;professional review&amp;amp;quot; of your skills. Progressing to Fellow FIPWS, either at direct entry level is possible for some of the more prominent members of the built environment, but is ultimately restricted to Surveyors and engineers who are already MIPWS and have been a member of IPWS for at least 3 years.&lt;br /&gt;

= Who can be appointed as a surveyor? =&lt;br /&gt;
&lt;br /&gt;
Under the Act, a 'surveyor' is any person who is not party to the works. Therefore, the property owner cannot act for themselves but anyone else is permitted to take on the role.&lt;br /&gt;
&lt;br /&gt;
The surveyor should however be experienced in construction and have knowledge of procedures under the Act (ref. [https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/207310/Party_Wall_etc._Act_1996_-_Explanatory_Booklet.pdf Department for Communities and Local Government 2013]).&lt;br /&gt;
&lt;br /&gt;
= Party wall award =&lt;br /&gt;
&lt;br /&gt;
If both parties agree on the appointment of a surveyor (an ‘Agreed Surveyor’), they will draw up an agreement (an ‘Award’) to resolve the dispute. Alternatively, each party can appoint their own surveyors to draw up the Award together (or select a third surveyor to determine the Award). An Award is a legally binding document that includes the following:&lt;br /&gt;
&lt;br /&gt;
* The work that will be carried out.&lt;br /&gt;
* How and when the work will be carried out.&lt;br /&gt;
* Any additional work required.&lt;br /&gt;
* Provision of access for the surveyor(s) to inspect the works as necessary.&lt;br /&gt;
&lt;br /&gt;

Its purpose is to provide a platform and structure upon which those professionals operating, or wishing to enter this specialist field of expertise are able to develop cohesively as a professional body in its own right.&lt;br /&gt;

The objectives of the IPWS is to ensure clarity and understanding when promoting, educating and training our members. Given that the party wall community comprises of an eclectic mix of professionals from various professional backgrounds. The stability that the IPWS will bring to its members will enable them to enhance their already considerable knowledge and develop together as a body, through relationships being forged with other professional bodies.&lt;br /&gt;
&lt;br /&gt;
The benefit of membership is two fold: firstly to ensure the highest standards are achieved and secondly, that the public gain confidence from our member’s status.&lt;br /&gt;
&lt;br /&gt;
As the institute gathers momentum, our profile rises due to the commitment of our members to be recognised for the consummate professionals that they are, and the partnerships we are forging with other professional bodies.&lt;br /&gt;
&lt;br /&gt;
There are four grades of membership, depending on your qualifications, experience and where you are in your career. Following your online application, we can point you towards the level that is most appropriate for you. If you're studying for your first job in the Built environment, you can apply for Student membership Student.&lt;br /&gt;
&lt;br /&gt;
If you've been a party wall surveyor with at least 1 year experience, and hold an academic qualification comparable to a Certificate or Diploma, or are a member of an established professional body such as CABE, you will be eligible for direct Associate membership AIPWS.&lt;br /&gt;
&lt;br /&gt;
Following an assessment and interview, progressing to professional member MIPWS, is achievable by experienced Surveyors, Engineers and managers with the equivalent of a foundation degree or HND/HNC, Member of CIOB, RICS, CABE, RIBA CIAT, IStructE, ICE, CMI and CIArb.&lt;br /&gt;
&lt;br /&gt;
The aim of most Surveyors and managers is to become a Member of the IPWS. This is a professional grade, and is granted after success at the &amp;amp;quot;professional review&amp;amp;quot; of your skills. Progressing to Fellow FIPWS, either at direct entry level is possible for some of the more prominent members of the built environment, but is ultimately restricted to Surveyors and engineers who are already MIPWS and have been a member of IPWS for at least 3 years.&lt;br /&gt;
&lt;br /&gt;
However, we do encourage those who believe they are worthy of the merit associated with the Fellow to come forward, as a professional body we will consider all the specialisms that our members bring to the profession&lt;br /&gt;
&lt;br /&gt;
We currently have vacancies within our advisory and management levels of the IPWS and welcome all applications.&lt;br /&gt;
&lt;br /&gt;
= Who can be appointed as a surveyor? =&lt;br /&gt;
&lt;br /&gt;
Under the Act, a 'surveyor' is any person who is not party to the works. Therefore, the property owner cannot act for themselves but anyone else is permitted to take on the role.&lt;br /&gt;
&lt;br /&gt;
The surveyor should however be experienced in construction and have knowledge of procedures under the Act (ref. [https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/207310/Party_Wall_etc._Act_1996_-_Explanatory_Booklet.pdf Department for Communities and Local Government 2013]).&lt;br /&gt;
&lt;br /&gt;
= Party wall award =&lt;br /&gt;
&lt;br /&gt;
If both parties agree on the appointment of a surveyor (an ‘Agreed Surveyor’), they will draw up an agreement (an ‘Award’) to resolve the dispute. Alternatively, each party can appoint their own surveyors to draw up the Award together (or select a third surveyor to determine the Award). An Award is a legally binding document that includes the following:&lt;br /&gt;
&lt;br /&gt;
* The work that will be carried out.&lt;br /&gt;
* How and when the work will be carried out.&lt;br /&gt;
* Any additional work required.&lt;br /&gt;
* Provision of access for the surveyor(s) to inspect the works as necessary.&lt;br /&gt;
&lt;br /&gt;

&lt;br /&gt;
The Award may also include a record of the condition of the neighbouring property before works begin.&lt;br /&gt;
&lt;br /&gt;
If the neighbour does not agree with the Award, it is possible to appeal to the county court within 14 days of issue.&lt;br /&gt;
&lt;br /&gt;
