If a home is rented on an assured shorthold tenancy (AST) that started after 6 April 2007, the landlord must put the deposit in a government-backed tenancy deposit scheme (TDP).&lt;br /&gt;
&lt;br /&gt;
Scotland and Northern Ireland have different TDP schemes, but in England and Wales deposits can be registered with one of either:&lt;br /&gt;
&lt;br /&gt;
* Deposit Protection Service.&lt;br /&gt;
* MyDeposits.&lt;br /&gt;
* Tenancy Deposit Scheme.&lt;br /&gt;
&lt;br /&gt;
By having the deposit secured in such a scheme, it provides assurance to a tenant that as long as they meet the terms of the tenancy agreement, don’t cause damage to the property, and pay rent and bills, that they will receive it back at the end of the tenancy.&lt;br /&gt;
&lt;br /&gt;
It is the responsibility of the landlord or letting agent to put the deposit in a scheme within 30 days of receiving it from the tenant. There is no requirement to protect a holding deposit, which is usually paid before signing a tenancy agreement, but this becomes a deposit once it has been signed.&lt;br /&gt;
&lt;br /&gt;
The landlord must still use a TDP scheme if the deposit is paid by a third party.&lt;br /&gt;
&lt;br /&gt;
Up to 30 days after receiving the deposit, the landlord must confirm and inform the tenant of certain details regarding the TDP:&lt;br /&gt;
&lt;br /&gt;
* The amount of deposit that has been paid.&lt;br /&gt;
* How the deposit is being protected.&lt;br /&gt;
* The name and contact details of the TDP scheme.&lt;br /&gt;
* The dispute resolution service provided by the TDP scheme and what to do if there is a dispute.&lt;br /&gt;
* Reasons that would cause the landlord to keep some or all of the deposit.&lt;br /&gt;
* How the tenant can apply to get the deposit back at the end of the tenancy.&lt;br /&gt;
